Basic Plan Subscription Agreement

This
Basic Plan Subscription Agreement ("Agreement") is entered into by and between
Anker Innovations Limited, trading as
eufy ("we,"
"us," or
"eufy"), and
you, the individual consumer ("you" or
"User"), who subscribes to the
Basic Plan
Service ("Service").
This Agreement may be updated or modified from time to time at our discretion. We reserve the right to revise, amend, or replace this Agreement as our products and services evolve. The most current version of the Agreement, as published on the official eufy website or within the eufy
App, shall always govern your use of the
Service. By continuing to use the Service after any update, you are deemed to accept the revised Agreement.
By activating or using any feature of this
Service, you acknowledge that you have read, understood, and agreed to be bound by the latest version of this Agreement.
Introduction
The
Basic Plan
Service is designed to enhance your home security and smart monitoring experience by integrating a suite of advanced features. The Service currently includes the following features:
3D Home Model: A visualized home environment featuring
3D modeling, digital avatars, and real-time interactive experiences.
4G Cellular Backup:
Ensure uninterrupted monitoring with a cellular network backup in case your primary
Wi-Fi connection fails.
eufy Expert GPT Assistant: An intelligent virtual assistant
offering AI-powered insights,
FAQ responses, and home security analysis.
eufyCare+: An
extended product protection plan that provides additional hardware warranty coverage for eligible eufy products, offered to consumers as a complimentary benefit with their purchase or subscription.
To access and use the Basic Plan
Service, you must:
(i)
Place an order for the Basic Plan through the official eufy website or the eufy
app.
(ii)
Bind the Service to a valid
HomeBase Professional S1.
The Service becomes active only after successful
binding and confirmation.
Subscription and Payment Terms
Free Trial Period: You are eligible for a free trial for six (6) months starting from the activation date. No charges will be made during the trial period.
Renewal and Payment: The
Service is offered under a
six (6) month
free trial for first-time users. After the free trial expires, you will be notified that your plan has ended. To continue using the Service, you must
manually place a new order to renew your subscription. There is
no automatic renewal.
If paid versions of the Service are introduced in the future, full pricing, payment methods, and renewal details will be provided clearly in advance.
Cancellation:
To cancel your subscription, you must contact eufy Customer Support directly.

support.expert@eufy.com. Cancellation takes effect after we process your request and send a written confirmation.
Cancellations may take time to process and may not be immediate.
Once your cancellation is confirmed, your
Basic Plan and all its associated features will be deactivated—including
3D Home Model,
eufy Expert GPT Assistant, and
eufyCare+.
Early termination of
the
Basic
Plan
renders
eufyCare+
null
and
void, as if the extended warranty had never been applied; your product will revert to the
original manufacturer warranty period.
Service Modification: eufy reserves the right to modify, suspend, or terminate the
Service (in whole or in part) at any time, with reasonable notice when possible.
Account
and Eligibility: You must maintain a valid eufy account and meet all applicable age and eligibility requirements to subscribe and use the
Service.
eufy Expert GPT Assistant
The
eufy Expert GPT Assistant ("GPT Assistant") is an AI-enhanced service designed to provide intelligent, contextual support and security insights.
Data Usage and Privacy
The
GPT
Assistant processes user input to generate responses and insights. We collect minimal necessary data for improving product performance as described in our
Privacy Policy. Your personal data will not be sold or shared for advertising purposes without explicit consent.
Limitations and Disclaimer
The GPT Assistant
may
occasionally produce inaccurate or incomplete responses. You acknowledge that its responses should not be relied upon for legal, medical, or other critical decisions.
eufy disclaims liability for any damages arising from reliance on AI-generated content.
3D Home Model
The
3D Home Model feature provides a visual and interactive experience to help you visualize and manage your
smart home more intuitively.
Data and User
Input
User-provided information (such as
layout data, address, or environmental settings) remains under your control. We use such data solely to deliver the
3D rendering and alert services. Data is processed in accordance with our
Privacy Policy.
Acknowledgment and Usage
The
3D Home Model is a visualization tool intended for entertainment and general informational purposes.
eufy makes no guarantees regarding accuracy of modeling or weather forecasting, and the
Service should not replace official meteorological or emergency alerts.
4G Cellular Backup Service
The
4G Cellular Backup Service ensures network continuity in case your primary internet connection is unavailable.
Acceptable Use:
You agree that:

You have no direct contractual relationship with the underlying carriers that provide network connectivity.

eufy and its service providers are not liable for interruptions, delays, or failures in data transmission.

The Service must not be used for emergency or 911-equivalent calls.

4G Cellular Backup Service connectivity performance depends on carrier coverage, network congestion, device capability, and environmental conditions; advertised speeds are indicative only.

You are responsible for maintaining appropriate security measures on any connected devices. You may not use the Internet Service to:

(i) Connect to medical devices, inmate locators, mobile personal emergency response services or any product that provides emergency calling to 911 or equivalent emergency telephone numbers.

(ii) Transmit cellular communication during outdoor flight.

(iii) Configure the 4G Cellular Backup Service to use a static IP address.

eufy and carriers may apply reasonable network management practices to optimize service quality.

A variety of factors can affect performance, speeds, and availability of the Internet Service, including but not limited to its services providers' coverage, network congestion, your devices and building characteristics, the capabilities and connections of the host of content to which you seek access, environmental factors, and technical operations, and any representations by eufy of the speed associated with any Product or Service represent only an anticipated, theoretical average speed, and not a guarantee of actual speed.

You are solely responsible for engaging all appropriate security measures associated with the Internet Service and all devices that connect to the 4G Cellular Backup Internet, and for providing, configuring and maintaining virus protection, firewall, and other security measures to prevent damage from viruses, malware, or other similar malicious content and to prevent unauthorized access.
If you are dissatisfied with this
Service, your sole remedy is to cancel your subscription under our cancellation policy.
Data
Allowance
Disclaimer:
The
4G
Cellular
Backup
Service includes a complimentary
400
MB
data
allowance. After this
data
allowance is
used, continued use requires additional data
purchases.
If no further data is purchased, the SIM card associated with the Service will automatically enter a
suspended or inactive state, and connectivity will no longer be available.
You can monitor your remaining data balance at any time via the eufy app.
eufy
is not responsible for service interruption resulting from data depletion or failure to recharge data.
eufyCare+ Plan Terms and Conditions
The terms and conditions of
eufyCare+ are set forth at
https://www.eufy.com/plan-terms-and-conditions.
In the event of any conflict between those terms and this Agreement,
this Agreement shall prevail.
General Terms
Modification of Terms
We may update this Agreement periodically. Any material changes will be communicated to you via email or in-app
notification before taking effect.
Disclaimers and Limitation of Liability
To the fullest extent permitted by law, the
Service is provided
"as is" and
"as available."
eufy disclaims all express or implied warranties, including merchantability or fitness for a particular purpose. In no event shall eufy be liable for indirect, incidental, or consequential damages arising from your use of the Service.
Informal Resolution Process
We believe most concerns can be resolved quickly and amicably. Before taking any formal legal action, please contact us at
support.expert@eufy.com with:

(i) A description of your concern.

(ii) Contact information.
-
(iii) The specific relief sought.
Both you and eufy agree to make good-faith efforts to resolve any dispute or claim ("Dispute") informally.
If the matter cannot be resolved within
thirty (30) days, either party may initiate legal action. This step is not required for emergency injunctive relief ("Excluded Dispute").
Choice of Law and Forum Selection
This Agreement and any related dispute shall be governed by the laws of the
State of Washington, United States, without regard to conflict of law principles.
All disputes shall be brought exclusively in the
state or federal courts located in King County, Washington (including Seattle or Bellevue). You consent to the jurisdiction and venue of those courts and waive objections based on inconvenient forum.
If you are a U.S. federal, state, or local government entity acting in your official capacity and cannot legally accept this clause, U.S. federal law shall apply, and, where federal law does not, the laws of the
State of Washington shall govern.
Time Limitation to Bring Claims
Any claim or cause of action arising out of or related to this Agreement must be filed within
two (2) years of the event giving rise to it. Claims not filed within that period are permanently barred.
Waiver of
Class Actions
To the extent permitted by law, you and eufy agree to bring claims only in an
individual capacity and not as part of any class, collective, or representative proceeding. Class-wide, consolidated, or representative actions are not permitted.
Miscellaneous
If any provision of this Agreement is deemed
void or unenforceable, the remaining terms shall remain in full force and effect.
This Agreement constitutes the entire understanding between you and eufy regarding the Basic Plan
Service, superseding all prior communications or agreements relating to the subject matter herein.
